Terms of Use

These terms govern your use of ChloroFile, an iPhone app for tracking plants you grow. By installing or using the app you agree to them. If you do not agree, please do not use the app.

What ChloroFile is

ChloroFile records information you enter about plants you grow: stages and dates, environment readings, photos, notes, and harvest results. It presents that information back to you as timelines, charts, and summaries.

It is a journal, not an authority. The app does not give horticultural, agricultural, legal, medical, or any other professional advice, and nothing it displays should be treated as such. Decisions about what you grow and how you grow it are yours alone.

Your responsibilities

You are responsible for knowing and following every law that applies to you, including any law governing the plants you grow, wherever you live. ChloroFile does not sell, supply, ship, or broker anything, and it does not facilitate any transaction.

You agree not to misuse the app: no attempting to break, probe, or overload the service, no accessing another person's account or data, no reselling or redistributing the app or the reference data bundled with it, and no using the app for anything unlawful.

The app is intended for adults. You must be at least 18 to create an account.

Your account

Most of ChloroFile works with no account at all. If you create one, you are responsible for keeping access to it secure. Tell us at support@chlorofile.app if you believe someone else has gained access.

You can delete your account at any time from Settings inside the app. Deletion is immediate and permanent: it removes your account and every record synced to it, along with the copies held on that device. We do not keep a backup of deleted accounts, so there is nothing to restore afterwards.

Your content

Everything you record in ChloroFile is yours. You keep all rights to it. We claim no ownership of it and we do not use it for any purpose beyond running the app for you.

You grant us only the narrow permission needed to operate the service: to store your records, transmit them between your own devices, and display them back to you. That permission ends when you delete the content or your account. How your data is handled in detail is set out in the privacy policy.

ChloroFile Pro

ChloroFile is free to use. Pro is an optional subscription that removes the free plan's limits on how many plants and environments you can track and how many metrics you can chart. The free plan remains usable indefinitely, and nothing you have recorded is ever deleted for want of a subscription.

Billing

• Subscriptions are sold and billed by Apple through your Apple Account, not by us. We never see your payment details.
• The price and billing period are shown to you in the app before you confirm, and payment is charged to your Apple Account on confirmation.
• Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours of the end of that period.
• You can manage or cancel a subscription in the iPhone Settings app under your name, then Subscriptions. Cancelling stops the next renewal; it does not refund the period already paid for.
• Refunds are handled by Apple, at reportaproblem.apple.com. We cannot issue them ourselves.
• If a free trial is offered, any unused portion is forfeited when you buy a subscription covering the same period.

If prices change, the new price applies only from your next renewal, and you will be told before it takes effect so you can cancel if you would rather not continue.

Reference data

The app bundles a catalog of plant varieties and equipment compiled from breeder catalogs and openly licensed datasets. It is provided for convenience as reference material. It describes varieties in general, and it is not a measurement of, or a claim about, the plant in front of you. Coverage is uneven and some entries are incomplete or out of date. Do not rely on it as fact.

Availability and changes

We aim to keep the service running but do not guarantee it will be uninterrupted or error free. Features may be added, changed, or removed as the app develops. If we make a change that materially reduces what a paid subscription provides, we will tell you, and you may cancel.

Because the app works offline, a service outage does not stop you using it or reaching your records on your device.

Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.

We do not warrant that the app will meet your requirements, that its calculations or reference data are accurate or complete, or that any result you record will be reproduced.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, crops, data, or goodwill, arising out of your use of the app.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five US dollars.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two sections above may not apply to you, and you keep any statutory rights that cannot be waived.

Ending these terms

You may stop using ChloroFile at any time by deleting the app, and delete your account from Settings. We may suspend or end access if these terms are seriously or repeatedly breached, and we will tell you why unless the law prevents it.

Changes to these terms

If these terms change, the date at the top is updated and material changes are noted in the app's release notes. Continuing to use the app after a change means you accept the revised terms. If you do not accept them, stop using the app and delete your account.

Governing law

These terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict of law rules. The state and federal courts located in Minnesota have jurisdiction over any dispute arising from them.

If you live outside the United States, you keep the protection of any mandatory consumer laws of the country you live in, and may be able to bring proceedings there.

Apple

Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support or maintenance for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; beyond that, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
